Terms of Sales

1. Service
 The content of the service is indicated on the reservation form.

 2. Price
 The price of cruises includes, unless otherwise stated on the booking form:
 • The provision and maintenance of the ship,
 • The wages and social charges of the crew,
 • Ship insurances and professional liability Shipowner.

 The price does not include, unless otherwise stated on the booking form:
 • Optional personal insurance for Passengers: cancellation, illness, accidents, repatriation, luggage, assistance ...
 • Air tickets, transfers or any other means of transportation for Passengers, from their point of departure to the port of embarkation and return,
 • Personal expenses, including telecommunications and land-based expenses of any kind,
 • Expenses related to the cash register

 3. Board case
 In addition to the price of the cruise, passengers will have to pay a mandatory "cash box", including:
 o the food and beverage expenses consumed on board (including those of the crew and any outside providers provided for in the cruise)
 o port and anchorage rights;
 o administrative costs (clearance, tourist taxes, ecological, tourist);
 o fuel costs (diesel, gas, gas) consumed during the cruise: they are fixed at a flat rate of € 5 per person per day.

 The payment of a deposit of 200 € per person is requested at the boarding, necessarily in cash, the ship is not equipped with Electronic Payment Terminal.  Additional installments are paid if necessary during cruising based on actual expenses.  The remaining balance is returned to the passengers at the end of the cruise.
 The mention of the shipboard on the offers and Passenger contracts in very clear terms, the Shipowner would not ship a Passenger who refuses to pay the amount.  Other items to be paid locally may be included on the order form.

4. Life on board
 The shipowner can not be held responsible for the impossibility of satisfying the requests for special diets (kosher, hallal, vegetarian, medical prescriptions).  Refueling is partially stopover: fresh produce, canned goods, not only local products.
 Alcohol consumption is limited to reasonable use.  The Captain is duty-bound to refuse alcoholic beverages to a person who is obviously intoxicated.

 The bathroom is composed of a cold water shower and a toilet.  The front bathroom is private and dedicated to the front cabin.  The rear bathroom is shared by the two rear double cabins.  A deck shower is also available to passengers at the level of the skirt.  Each cabin has a private washbasin.  Side windows are sometimes not open and sized to avoid intrusion.  The very simple use of the WC is clearly explained by the crew at the arrival of the Passengers.  In normal use, they can not clog.  It is mentioned that any introduction of unintended objects (wadding, sanitary tampons, cotton swabs) can break them down.  In this case, for dissuasive purposes, the unloading will be charged € 60 to the Passenger.  There may be no 220 V plug in the cabins.  In this case, Passengers have in the square taken to recharge mobile phone, micro-computer, camera, etc.  We do not provide bath towels or hospitality products.

 There is no cook or hostess / steward on board.  During the cruise, the kitchen and the service, as well as the household of the cabins, the rooms of water and the common parts are taken care by the passengers.

 Each passenger is entitled to a luggage preferably flexible and waterproof, and not exceeding the dimensions of type "luggage-cabin".  Passengers must be very vigilant with their electronic devices, phone, camera, camera, computer, especially provide waterproof covers when they board the annex and not leave them visible outside their cabin.  The Shipowner advises against carrying valuables or large sums in cash and declines any responsibility in the event of theft, damage or loss.  Passengers are responsible for the proper closing of the portholes in their cabin.  The Shipowner can not guarantee the comfort of Passengers in bad weather conditions.

 5. Common equipment
 The annex is motorized.  It allows to board only a limited number of passengers simultaneously.
 There is a first aid kit on board the ship, which includes only the emergency products defined by the Maritime Affairs Department according to the EC standards.  It is the passengers' responsibility to bring their own medicine.
 We advise guests to bring their own snorkeling equipment (fins, mask, snorkel) to enjoy underwater landscapes.  For safety reasons, we do not accept aboard, kitesurf or windsurfing (except dedicated cruises or exclusivities with ACCORD WRITTEN PREALABLE).  We never accept scuba diving equipment or scuba diving.
 It is possible to fish from the edge subject to respect the rules and prohibition zones.  Some types of fishing may pose a hazard to passengers or vessels: Comply with crew instructions.  Equipment is not provided, Passengers can bring their own.  We do not provide books or board games.

6. Embarkations
 Boarding cards, with explanations for joining the ship will be sent (exclusively by email), 3 days before boarding.  The Shipowner is not responsible for the means of transport chosen by the Passengers to go to the ports of embarkation and return to their home.  It is advisable to provide sufficient connection times and changeable transport tickets.
 The arrangement of the cabins begins on Day 1 at the time of boarding to end the Day n at the time of disembarkation as mentioned on the order form, to allow the reordering of the ship and to make supplies  .  Passengers will in no case enter the ship before boarding time nor deposit their luggage.
 The shipowner has no baggage deposit.
 In the event of a late presentation at the boarding meeting, except for vessels reserved exclusively, the Captain, after a reasonable period of time, must sail to avoid delaying the other Passengers.  In the event that Passengers can not board this fact, there will be no compensation and the eventual catching up of the ship, if it is possible, will be entirely at their expense.
 The Port of Embarkation is mentioned on our offers as an indication, some cities or small islands have several ports close to each other.  The precise point of departure is always mentioned on the boarding pass.

 7. Functions of the crew
 Captain: Conduct and responsibility of the ship, maintenance of the engine and gear and possible troubleshooting if possible, paperwork, shifts.  He is in charge of the relations with the Authorities and the Passengers for all that concerns the organization of the cruise.  The captain is registered maritime and graduated in accordance with French regulations.

 There is no cook or hostess / steward on board.

 8. Miscellaneous
 Passengers undertake to respect the safety instructions (briefing by the boarding crew) including restrictions on smoking possibilities.  Passengers must first sign the safety instructions.  Vessels benefiting from preferential customs regimes, no goods, or element of bunkering can be landed ashore.
 We are not responsible for any deviations or distortions of age, gender, language between passengers.  In shared cabin bookings, we do not accept minors and we do not take into account the gender or age of the people sharing the cabin.  We can not accept duplicates to be shared by separate bookings.
 The Passenger remains responsible for any damage or loss of equipment, payment of services (wireless communications or other), incumbent upon him and which would remain due.  In case of night navigation, in bad weather, in some anchorages or for security reasons, the crew can be brought to sleep in the square.  In some countries, on certain ships, the crew can solicit passengers the occasional use of their bathroom, which a passenger is entitled to refuse.

9. Force Majeure Event
Will be considered as such, without this list being exhaustive: Acts, events, no events, accidents, "Acts of God" beyond the reasonable control of the Shipowner or Shipper, including strikes outside the parties , lock-out or other social conflicts, demonstrations, riots, blockades, invasion, war, fire, explosion, sabotage, severe weather problems, collision, grounding, governmental act or regulation, (including opinion of the Ministry of Foreign Affairs of the imposing emitting country to suspend the destination), major technical failure, serious diseases, or diverting during the period of use (international maritime regulations require assistance and rescue at sea). The Passenger undertakes to tolerate the necessary relief interventions and any delay or inconvenience that may result. The Captain is the sole judge of the decisions to be made. In the event of problems due to Force Majeure, the Shipowner can not be held responsible and will have no obligation to provide a vessel or alternative accommodation, reimbursement, repatriation or compensation to any in particular, the costs of returning the port of landing to the passengers' homes.

In case of absolute official prohibition of the destination by the French Ministry of Foreign Affairs, significant deterioration of the interest, the state or the security of the stops, whatever the cause, or absolute impossibility to reach the port of embarkation for unavoidable reasons and totally independent of the will or the possibilities of the passengers themselves, (not taken into account: strikes, delays, cancellations, relating to transport, companies, ports, airports and related services), the lost cruising days, from a full day until the total cruise, will be offset by a credit on a future cruise whose date will be established by the shipowner according to the schedule.

10. Itineraries
Our itineraries, travel times and stopovers are given as an indication and can be modified according to imperatives especially meteorological in order to avoid as much as possible to navigate in conditions of discomfort. Stops mentioned at the dock are likely to be anchored if there is no available berth. Similarly, an anchorage stop may be replaced by a stopover at the wharf. Embarkations / landings are usually carried out in annex. The journey times correspond to normal sea conditions. The navigation is primarily made to sail, except in cases where, the direction of the wind, its insufficiency, or any other maritime or meteorological phenomenon, as well as any need of schedules, require the use of engines. For various reasons, including weather, the route can be reversed. Likewise for multiweek cruises combining several circuits, the order can be reversed. The maps and photos appearing on our documentations are not contractual. Only the elements mentioned in our contracts are authentic.

11. Compliance with safety rules and regulations
Passengers undertake to respect the safety rules given at the safety briefing and to sign the report before departure.
Passengers forbid:
- To oppose the "Cabin Air Regulations" of the Shipowner.
- To introduce, to allow to enter on board, without authorization of the Captain, persons not appearing on the list of Passengers.
Passengers are not allowed to fly the schedule unless authorized by the Captain and only in the presence of a member of the crew.
Embarkation of any weapon, substance or illegal material, in France or in the countries crossed, is strictly prohibited. Any fine or financial consequences of non-compliance with this rule, both for the passenger and the shipowner, will be the sole responsibility of the Passenger concerned. The crew is on duty to immediately disembark any offender and inform the competent authorities.

The Passenger is solely responsible for the compliance of travel documents, passports, visas and vaccination certificates, for himself and the persons accompanying him, according to the regulations of the countries addressed, in particular for Passengers of nationalities outside the Schengen Area, or for children (it is reminded that children must have their own passport). Some countries are very demanding on the accompaniment of minors and the documents necessary for their admission. Parents must check the necessary documents with the competent authorities.
In case of international navigation, the Passenger must send the Shipowner a photocopy of the passports of all boarders, at least 10 days before departure to prepare the Outlet Statements of the Territory and avoid any delay in boarding. Providing copies of passports does not relieve the Passenger of responsibility for compliance with administrative requirements.
Any information provided by the shipowner concerning the formalities in the countries crossed concerns only persons of full age and of French nationality. For all other cases, the Passenger will have to consult the concerned Consulates, in particular for the authorization of entry-exit of territory for the minors.
The Passenger must indicate, at least 30 days before the departure, the presence of children under 12 years or passengers under 30 Kg (special vests mandatory) and prior to the registration of frail persons or presenting possible health risks, otherwise boarding could be refused without reimbursement or compensation.
For safety reasons, the shipowner will not board disabled or wheelchair passengers. Passengers must be able to embark alone from the annex to the skirt of the sailboat. The booking may be canceled in the absence of a medical certificate attesting to the suitability of the Passenger to participate in the cruise concerned (mandatory model on request). In this case the following cancellation fees will apply.
Passengers must inform the Shipowner prior to booking of any health risks and in this case must provide an explicit medical certificate of non-contra-indication. Otherwise the Shipowner can not be held responsible for the harmful consequences that may result. The crew can not under any circumstances have a surveillance or childcare function. The Passenger releases the Shipowner and his staff from any responsibility for their supervision which must be carried out directly and permanently by the parents. Very young children and babies can only be boarded on exclusively reserved vessels. In the case of babies, their food must be provided by the parents.
The Shipowner declines any responsibility in the event of an accident resulting from the practice of activities, sports, water or land made by Passengers during the cruise, or ashore during stopovers. In these cases, the Passenger must have his own insurance and the Shipowner has no duty of assistance or repatriation which remain entirely the responsibility of the Passenger concerned.

12. Tourist information and excursions
The Shipowner and his associates can sometimes provide information about local excursions or different providers. The shipowner has no control over these service providers, does not receive any remuneration from them and declines all responsibility in case of any problem of any kind. It is reminded that we require from our crews a perfect knowledge of the sea, however, they are not tour guides. Our job is the cruise, we have no vocation to organize visits, activities or other outside our ships. We do not accept any liability for any event on shore, especially outside the supervision of the crew. The crew speak fluent French and English.

13. Refusal of boarding, early disembarkation
The Captain will refuse to ship Passengers who are not in compliance with the regulations of the countries concerned, children under 10, whose exact date of birth would not appear on the travel contract, persons whose disability would not have been reported when booking, or any Passenger refusing to sign the security instructions. Even small animals will not be accepted on board, except in case of a written derogation for exclusively reserved vessels.
The Captain will disembark any Passenger whose behavior could seriously endanger or inconvenience other Passengers, crew members or the ship or whose state of health would appear to him to be incompatible with the cruise. The fact of not having previously detected a possible incompatibility of health does not imply recognition of its acceptance.
In the event of non-embarkation or disembarkation of Passengers, at their own initiative, that of the Captain or the local authorities, for any reason whatsoever: delay of transport, non-conformity of travel documents, personal suitability, health, aptitude, behavior, illegal acts, etc., the Shipowner will not be held to any assistance, nor the assumption of any expenses (lodging, repatriation, fines, legal assistance, medical, etc.). In the cases previously stated, no refund or price reduction will be granted.
Any costs of repatriation or accommodation of passengers arriving in advance for any reason whatsoever, the fees and expenses of intervention on board or land of health professionals or assistance regarding Passengers, fines, expenses of justice and assistance, penalties, miscellaneous expenses incurred by Passengers because of their behavior, are the sole responsibility of the Passengers concerned.

14. Cancellation / Modification / Late payments
Pursuant to the provisions of Article L 121-21-8 of the Consumer Code, the services offered do not benefit from the right of withdrawal provided for in Articles L 121-21 et seq. Of the Consumer Code regarding distance selling. . Consequently, the services ordered are exclusively subject to the cancellation and modification conditions provided for in these General Terms and Conditions and the user can not invoke the right of withdrawal. The payment of a deposit implies acceptance of the offer and these General Conditions of Sale even without a physical signature of the booking form. In case of cancellation or change of date due to the Passenger whatever the cause, the following cancellation fees will be due: Cancellation before departure: Up to 90 working days, cancellation fees: 25% the total amount /// from 89 to 60 working days: 50% /// from 59 to 30 working days: 75% /// from 29 working days until departure: 100% of the price of the stay. Ships reserved exclusively: increase of 20% cancellation fees.
Change of date, if available, to more than 90 working days from the date of departure: Advanced date 5%, date postponed 1% per day off with a minimum billing of 21 days and maximum of 35 and application of the tariff in force at day of the change.
From 89 to 45 working days of departure, advanced date 20%, date postponed 40%. Within 45 working days of departure, the change will bear the costs of a cancellation. Any request for cancellation or modification must be notified by registered mail addressed to the registered office of the company. A postponement of the date if it is accepted does not allow a postponement of the cancellation thresholds which remain based on the calendar dates of the original file. The signature of a quote, order form, confirmation by email or the payment of a first partial deposit will immediately and definitively commit the Passenger, who may cancel only in the context of the foregoing. The non-presentation of Passengers at boarding, or denied boarding for any reason is considered a cancellation by the Passengers on the day of departure.
Passengers are advised to take out travel insurance covering all the risks incurred, in particular: cancellation, repatriation, loss and theft of luggage, medical expenses, accidents, legal assistance, cancellation of their air tickets or other tickets, consequences of a delay. Insurance included in payment cards is sometimes restrictive and difficult to implement. Any accidents occurring during the cruise would be covered by our own liability insurance only in the event that there is fault on our part. In the absence of fault causing the accident, it is exclusively the insurance of the passenger who is concerned.
In the case of boats booked "at the cabin", departures are guaranteed from the moment 2 passengers have reserved 2 separate cabins (or 3 passengers in 2 separate cabins). If the number of passengers is too small, the cruise may be canceled. The shipowner will immediately refund the amount of the sums paid by the passenger, who will not be able to claim any other reimbursement or additional compensation, in particular with regard to his transport or accommodation expenses. In the event of cancellation by the Shipowner for reasons beyond his control: serious breakdown, delay due to weather conditions, unavailability of a ship, the latter shall immediately refund the amount of sums paid to him by the Passenger, who would not be entitled to any other reimbursement or additional compensation, in particular as regards his transportation or accommodation expenses. In the event of a reduction in the duration of the cruise for reasons of force majeure, the shipowner will reimburse exclusively the proportion of days not provided. In the event of a diversion for safety reasons at the request of the Maritime Authorities, the Shipowner will not make any refund.
In case of late payment, it will be due in addition to the amounts due, 0.3% per day late from the due date.
If the Passenger fails to pay any sum payable under this contract, the Shipowner, 7 days after a formal notice by email, or, without payment 14 days after the due date, would have the right to consider this contract as broken by the Passenger, to keep the total amount of all payments already made before break, to charge the corresponding cancellation penalties and to remarket the cabins. The payment on boarding the balances due is not accepted.

15. Litigation, attribution of jurisdiction
For the execution of the present, the parties make election of domicile each in their respective seat or domicile, indicated at the top of these presents. In case of dispute, the dispute would be submitted to the Courts of Paris, which is given exclusive jurisdiction, even in the event of an appeal in warranty or plurality of defendants. By express agreement, the contract and its possible consequences will be governed by French law. If any of the clauses of the contract or the General Conditions should be declared inapplicable or invalidated for any reason, this invalidity or inapplicability will not affect the application or the validity of the other provisions. The Shipowner's liability can never be incurred for indirect damages. To be valid, any claim must be served on the shipowner within 30 days of landing.
